Gameplay Galaxy Limited (Gameplay Galaxy”, Company” “we” or us”) respect the privacy of the users of our website at: https://www.gameplaygalaxy.com/ (the Site”) and our mobile application referencing this Privacy Policy (the App” and together with the Site – the Services”), and are committed to protecting the personal information that users share with us in connection with the use of the Services.

This Privacy Policy (the Privacy Policy”) is intended to describe our practices regarding the information we may collect from you (the User” or you”) when you use the Services (or any part thereof), the manners in which we may use such information, and the options and rights available to you.

Capitalized terms that are not defined herein shall have the meaning ascribed to them in our Terms of Use available at https://www.gameplaygalaxy.com/license-agreement/(the TOU”).

  1. Which information we may collect on our Users?

We may collect three types of data and information from our Users:

  • Personal Information, which is individually identifiable information, that identifies an individual or may with reasonable effort identify an individual, either alone or in combination with other information, or may be of private or sensitive nature; and
  • Non-personal Information, which is non-identifying and non-identifiable information, without particular reference to the identity of the User from which such information was collected.
  • Blockchain and Digital Assets Information, is any information related to your use of the Blockchains and Digital Assets in connection with your use of the App, including your GPG Wallet’s public key, information related to your purchases, transfers, withdrawals, and exchanges of your NFTs via the Marketplace or through any other medium, transfers from the GPG Wallet to a digital wallet offered by a third party (a “Third-Party Wallet” and “Third-Party Wallet Provider”, respectively). Please note that such transfer shall also be subject to the relevant Third-Party Wallet Provider’s privacy policy and terms of use, kindly review such privacy policy and terms of use before conducting any transfer thereto as Gameplay Galaxy shall not be liable for any such third-party conduct.

For the avoidance of doubt, any Non-personal Information and/or Blockchain and Digital Assets Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.

Information which is being gathered in connection with the Services may consist of the following:

  • If a User registers to the Services (via the App or Site), such User may be required to provide us with its email address. Thereafter, the User may voluntarily provide, but is under no obligation to provide, his/her Username, User’s country, gender, date of birth, or picture, Users address.
  • the User may voluntarily provide or otherwise make available to Gameplay Galaxy additional Personal Information (as User-Generated Content) or any Personal Information which may be contained in your communication with us, including inter-alia when you contact us to receive support or information in connection with your use of the Services, and other information which User may voluntarily provide while registering to and using the Services or while logged-in to his/her Account
  • As the User enters and/or uses the Services, he/she may automatically provide us with his/her IP address or other persistent user and/or mobile device token, advertising ID, geolocation information (as applicable), which is used mainly for enhancing the User’s experience and for geolocation, personalization, and security purposes, as further detailed below.

The User of the Services may also automatically provide us with certain technical information, such as the User’s device type, operating system, browser type and version, screen resolution, browser and keyboard language, the User’s ‘click-stream’ and activities on the Services, the period of time the User visited the Services and related timestamps, etc.

  1. How do we collect Information on our Users?

We use the following methods of collection:

a. We collect Personal Information and Non-personal Information through your use of the Services. In other words, we may be aware of your use of the Services, and may gather, collect, and record the information relating to such usage, either independently or through the help of third-party services as detailed below. We may also collect Non-personal Information through the processing, analysis, and anonymization of Personal Information provided by you.

b. We collect Personal Information and Blockchain and Digital Assets Information which you provide us voluntarily. For example, we collect Personal Information in the course of your use of the Services, including when you register and open an Account on the App by completing the registration form, when you provide us additional information during your use of the Services, or when you contact us directly.

We store the Non-personal and Personal and Blockchain and Smart Contract Information either independently or with the help of our authorized third-party service providers as detailed below.

3. What are the Purposes of the Collection of Information?

We collect the above-mentioned information, using advanced techniques, in order to provide and operate the Services, and to give our Users information to use as applicable to their specific use; to use on an aggregated, statistical basis to discover patterns, trends and anomalies; to enable us to further develop, customize and improve the Services based on Users’ common preferences, uses, attributes and anonymized data; to mint Digital Assets to you when you use the App; to enable us to provide our Users with a better user experience, with more relevant and accurate information, services, third party services, features and functionalities, statistical and research purposes, for compliance and protection purposes (e.g., to comply with applicable law, enforce our terms and conditions, and prevent and detect cyberattacks), and to deliver advertising and other commercial or sponsored content.

4. Legal Basis for collection and Use of Personal Information

We collect, process, and use your information for the purposes described in this Privacy Policy, based at least on one of the following legal grounds:  

  • With your consent: We may ask for your agreement to process your information for specific purposes, and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with personalized content and ads through the use of cookies.
  • When Performing this Agreement: We collect and process your personal information in order to provide you with the Services; to maintain and improve our Services; to develop new services and features for our Users; to provide you with support in connection with your use of the Services; to mint Digital Assets to you in connection with your use of the Services; and to personalize the Services in order for you to get a better user experience.
  • Legitimate interests: We process your information for our legitimate interests while applying appropriate safeguards that protect your privacy. This means that we process your information for things like detecting, preventing, or otherwise addressing fraud, abuse, security, usability, functionality or technical issues with our services, protecting against harm to the rights, property or safety of our properties, or our users, or the public as required or permitted by law; enforcing legal claims, including investigation of potential violations of this Privacy Policy or our TOU; in order to comply and/or fulfill our obligations under applicable laws, regulation, guidelines, industry standards and contractual requirements, legal process, subpoena or governmental request, as well as our TOU.
  1. Where Do We Store Personal Information?

Personal Information regarding the Users will be maintained, processed, and stored by Gameplay Galaxy and our authorized affiliates and service providers in the USA and around the globe. When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for Personal Information, and we will comply with applicable data protection laws. 6. Sharing Information with Third Parties

Gameplay Galaxy may share your information: (a) to provide the Services, at your request and choice, including certain features you elect to use that enable communications between Users, enabling the sharing of Users’ Generated Content with other users and communication between Users and Gameplay Galaxy’s third party authorized partners or other third parties (including, when you transact in Digital Assets, in which case such transactions shall be visible on the relevant Blockchains); (b) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (c) to enforce this Privacy Policy and/or the TOU, including investigation of potential violations thereof; (d) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User’s support requests; (e) to respond to claims that any content available on the Services violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of Gameplay Galaxy, any of its Users, or the general public; (h) when Gameplay Galaxy is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (i) to collect, hold use and/or manage your Personal Information through Gameplay Galaxy’s third party service providers, as reasonable for business purposes (including for purposes of providing and promoting the Services), including such third party service providers that are located outside of the USA; (j) pursuant to your explicit approval prior to the disclosure.

For avoidance of doubt, Gameplay Galaxy may transfer and disclose to third parties or otherwise use Non-personal Information at its own discretion.

7. Retention, Modification, and Deletion of Personal Information

Gameplay Galaxy will maintain your Personal Information and Blockchain and Digital Assets Information as long as you are using our Services or as long as such information is publicly available on the Blockchains. If for any reason you wish to modify, update, revise and/or delete your Personal Information stored with us and identifies you, you may do so on either (i) on the Services by editing your information on your Account, or by (ii) deleting your Account from the Services, in which case we will delete any such Personal Information pursuant to any applicable privacy laws.

We will retain your Personal Information as necessary to comply with our legal obligations, to resolve disputes, to prevent fraud and abuse, to enforce our agreements, and/or protect our legitimate interests. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of Personal Information, the purposes for which we use Personal Information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements. ),

Where we no longer need to process your personal information for the purposes set out in this Privacy Policy, or following your request to delete your Personal Information, we will delete your Personal Information from our systems and/or anonymize your information.

8. Minors

To use the Services, you must be over the age of eighteen (18). Gameplay Galaxy does not knowingly collect Personal Information from children under the age of eighteen (18). In the event that it comes to our knowledge that a person under the age of eighteen (18) is using the Services, we reserve the right to prohibit and block such User from accessing the Services.

9. Cookies

a. What are cookies?

Cookies are small text files placed onto your device (computer, mobile phone, etc.) by certain websites that you visit and generally collect standard internet log information and visitor behaviour information. They are widely used to make websites work, or work more efficiently, as well as to provide information to the owners of the website.

Cookies can be ‘first-party’ or ‘third-party’ depending on the domain that sets them. First-party cookies are set by us and information collected from these cookies is used by us in accordance with our Privacy Policy. Third-party cookies are set by third parties and information is collected and used in accordance with those parties’ privacy policies. Our Site uses both persistent and session cookies:

  • Strictly Necessary. These cookies are necessary for our Site to function correctly. They enable you to move around our Site and use our Site features. As these cookies are necessary for the provision of our Site to you, we do not require your consent for their use.

We may use your contact details for the purpose of informing you regarding our products and services (which may interest you, and to send to you other marketing material, including news and updates) as part of the Services (including via the App and/or the Site), and/or transmitted to the e-mail address or phone number you have provided or by displaying you this information on the Application to you.

You may withdraw your consent via sending a written notice to Gameplay Galaxy by email to the following address: [email protected] or by following the opt-out or unsubscribe instructions contained in the communications that we send you.

Please note that Gameplay Galaxy may also contact you with important information regarding our Services. For example, we may notify you (through any of the means available to us) of changes or updates to our Services, payment issues, service maintenance, etc. You may not be able to opt-out of receiving such service messages. 

11. Security

Gameplay Galaxy employs industry standard procedures and policies designed to ensure the safety of its Users’ Personal Information, and prevent unauthorized use of any such information. However, we do not and cannot guarantee the security of your Personal Information, including that unauthorized access will never occur.

We recommend using the strongest password combination available on your mobile device to protect unauthorized access to your mobile device.

 12. Third Party Websites

While using the Services you may encounter links to third party websites and/or services and/or products. Please be advised that such third party websites and/or services and/or products are independent from Gameplay Galaxy and may use cookies and other web-tracking technologies to collect Non-Personal and/or Personal Information about you. We assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such third party websites and/or services and/or products. We encourage you to carefully read the privacy policies and the terms of use of such third party websites and/or services, as their terms, not ours, will apply to any of your interactions with such third parties.  Gameplay Galaxy has no control over the use of any information you provide by these third party services.

13. Changes to the Privacy Policy

Gameplay Galaxy reserves the right to change this Privacy Policy at any time, so please re-visit this page frequently. We will provide notice of substantial changes to this Privacy Policy on the Services and/or we will send you an e-mail regarding such changes to the e-mail address that is registered with your Account.

14. Your Rights

Applicable data privacy laws (which may include, without limitation, the European General Data Protection Regulation (GDPR)) have granted individuals rights in connection with their Personal Information and how their Personal Information is processed.

If for any reason you wish to exercise any rights to which you are entitled, you may do so by contacting us at [email protected]. When handling these requests, we may ask for additional information to confirm your identity and your request.

Depending on your location and the nature of your interactions with our Services, you may request the following in relation to personal information:

  • Information about how we have collected and used Personal We have made this information available to you without having to request it by including it in this Privacy Policy.
  • Access to a copy of the Personal Information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Correction of Personal Information that is inaccurate or out of date.
  • Deletion of Personal Information that we no longer need to provide the Services or for other lawful purposes.
  • Withdrawal of consent, where we have collected and processed your Personal Information with your consent.
